Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Intelya ("Intelya", "we", "us"), governing your access to and use of the Intelya mobile application and website.

You must be at least 13 years old to use Intelya. If you are under 18, you represent that you have your parent or guardian's permission.

2. Description of Service

Intelya is an AI-powered music generation service that allows users to create songs from text lyrics. The service operates on a credit-based system. Credits are consumed when you generate songs. Some features are only available on paid subscription plans.

3. Account Registration

• You must provide accurate, complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately at support@intelya.ai if you suspect unauthorized access to your account.
• You may not create multiple accounts to circumvent usage limits or obtain additional free credits.
• One account per person. Accounts are not transferable.

4. Credits and Subscriptions

4.1 Free Credits

New accounts receive 3 free welcome credits upon registration. These credits do not expire but cannot be transferred, sold, or refunded as cash.

4.2 Paid Subscriptions

Paid subscription plans are billed monthly. Subscriptions are managed through Apple App Store or Google Play and are governed by their respective terms. Credits included in your monthly plan reset on your billing renewal date — unused credits do not roll over.

4.3 Credit Usage

• Draft quality: 1 credit per generation
• Standard quality: 2 credits per generation
• High quality: 3 credits per generation

Credits are consumed at the start of generation. If a generation fails due to a server error on our side, credits will be refunded within 24 hours. Credits are not refunded for user-initiated cancellations or dissatisfaction.

5. Acceptable Use

You agree not to use Intelya to generate content that:

• Is illegal under applicable laws of your jurisdiction.
• Promotes violence, terrorism, or hatred.
• Infringes intellectual property rights of others.
• Is sexually explicit or obscene.
• Defames, harasses, or threatens others.
• Contains personal data without consent.
• Is deceptive or fraudulent.

We reserve the right to suspend or terminate accounts that violate these rules.

6. Intellectual Property — Your Content

You retain full ownership of the lyrics you input. By submitting content, you grant Intelya a limited license to process it for song generation.

Generated songs are owned by you, subject to plan-based licensing:

• Free plans: Personal use only.
• Paid plans: Include a commercial usage license.

Intelya retains all rights to its technology, platform, and branding.

7. AI-Generated Content Disclaimer

Intelya uses AI models to generate music. We do not guarantee output quality or uniqueness. You are responsible for reviewing generated content before use.

We are not responsible for similarities to existing works. Verify content before commercial use.

8. Termination

You may delete your account anytime via app settings or by emailing support@intelya.ai. Data is deleted within 30 days.

We may suspend or terminate accounts for violations or misuse. If we terminate without cause, we may provide a pro-rata refund where applicable.

9. Limitation of Liability

Intelya is provided "as is" without warranties. To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Our total liability is limited to the amount you paid in the last 3 months.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be subject to the jurisdiction of courts located in Tennessee.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via app or email. Continued use means acceptance.
